Terms of Service
By commissioning my services, you agree to the following Terms & Conditions
> GENERAL <- I retain all rights to my work.- I reserve the right to change, reproduce, post the work online, and use it for self-promotion unless discussed.- I reserve the right to refuse commissions for any reason.- I reserve the rights to watermark and/or sign my work.- Watermarks are non removable and must be present when used.- Pricing will vary depending on character complexity.- Payment will be made in full, either before the commission begins or during the sketch phase.*
*Alternative plans may be made under my discretion.- Free revisions will be given during the sketch phase. Any considerable change following this phase will be charged.- AI created and derivable works will not be allowed. Do not commission me if the model/reference is AI generated.- Usage of deliverables in NFTs, Cryptocurrency or AI derivative works is forbidden.- Commissions for racist, sexist, and any other offensive imagery will be refused.- When using my works, I must be visibly credited and linked back to.- You are not allowed to change, modify, or edit my works without my permission (Non-permanent edits are allowed).- You are not allowed to trace my work.- If the Client fails to respond 2 weeks after the commission has started, the commission will be put on hold. After 1 month, no refund will be given and I reserve all rights to the work completed prior to cancellation.- The Client can choose to have the commission done in secret. An additional fee of up to 10% will be added. This will be discussed with the client.- As the Client, you must be of legal age to commission my services.- The Client must have sufficient funds ready to pay for the commission in a timely manner.- The Client must own all materials (excluding references) provided to me.- The Client is aware of the commission phase and agrees to the assigned time slot (if any is provided).- You cannot sell the rights to my work to others without my permission.- You are required to contact me to cancel any commission arrangements.- You are expected to fill out my Commission Application form.- No harassment over communication will be tolerated.- I am not responsible for unsatisfactory elements if no feedback from the Client was provided.- It is your responsibility to ensure details are accurate.- No WIP will be posted online without prior arrangements.
> VTUBER MODEL / RIG <
- The model can be used for streaming, content creation, and other personal uses.- Credit is required (Twitter Bio/YT Bio/Twitch Panel).- The full PSD will be given to you.- After the order is completed, minor changes will be provided due to my faults causing inaccurate/overlooked details.- Following 2 weeks of the delivery, any revisions to the model will be charged with additional fees.
> COMMERCIAL USAGE <
- Current commission prices are for NON-COMMERCIAL purposes only.*
* Exceptions include: emotes, Live2D Model / Rig
* Commercial prices may be up to 2x the original price. This will be discussed with the Client.
> SALES <
- All sales are considered "Digital Artwork"- Nothing is shipped physically.
> TRANSACTIONS <
- It is not my responsibility for any mistakes made by the Client over the transaction.- I accept Canadian dollars. You are responsible for the currency conversion.- I will cover any fees taken from the platforms.- You have 2 weeks following the delivered commission to pay the final amount.- Failure to pay will result in a blacklist.
> REFUNDS <
- If the refund is asked before work has started, a full refund will be granted.- If the refund is asked following the sketch phase, no refund will be granted.- If the refund is asked after the first sketch is provided, no refund will be granted.- If a Payment Plan is agreed upon and the commission has began after the first deposit, no refund will be given if the Client backs out of the Plan.
> CHARGEBACKS <
- Chargebacks are not authorized for any reason. All rights given to the Client for usage of deliverables will be removed if chargebacks occur and all corresponding accounts will be placed on an immediate blacklist.- If your payment method authorizes a refund without your knowledge, you must contact me and resolve it immediately.> PROCESS <
- Depending on the commission, you may expect to wait anywhere from 2 weeks to 6 months. I will let you know of any waiting arrangements.
- I will send you sketches of what you want during my "sketch phase" where I will revise with you the commission. Please note that drastic changes may be subject to additional fees.
- Expect me to contact you at least once every 2 weeks updating you on the process once I have began the commission.
